Islamabad: Chief Election Commissioner Sikandar Sultan Raja replied to the President's letter regarding the date of general elections:

The Chief Election Commissioner has said in the reply letter written to the President Arif Alvi that the National Assembly was dissolved by the President on August 9 on the recommendation of the Prime Minister under Article 58-1 of the Constitution, now section 57 of the Election Act was amended on June 26. Yes, before this amendment, the President used to consult the Commission for the date of the election, now after the amendment in Section 57, the Election Commission has the power to give the date or dates.

According to the letter, Article 48 of the Constitution should be read with Article 58 of the Constitution, if the Assembly is dissolved on the recommendation of the Prime Minister, then the Commission has the authority to give the date of general elections.

The letter states that Clause 5 of Article 48 of the Constitution is unobstructed, if the President dissolves the Assembly using the powers under Sections 58-2, 48-5, he gives the date of election, under Article 48-1 of the Constitution, the President and the Prime Minister It is on record that the National Assembly was dissolved on the advice of the Prime Minister, so Article 48 Five is not considered, but if the President dissolves the Assembly on the recommendation of the Prime Minister under Article 58 One, then it is up to the Election Commission to give a date. There is an option.

The letter further states that if the President dissolves the Assembly using the powers under 582 and 485, then he gives the date of the election, but if the President dissolves the Assembly on the recommendation of the Prime Minister under 581, then it is the Election Commission's authority to give the date.

According to the letter, under Article 48-1 of the Constitution, the President shall act on the advice of the Prime Minister and Clause 5 of Article 48 of the Constitution is unobstructed, while it is on record that the National Assembly was dissolved on the advice of the Prime Minister. 48 Five is no longer worth considering.

The letter states that the conditions given in your letter are not applicable in the current situation, constituencies are also going on in the country, the Election Commission decided to conduct constituencies under Section 17-2 of the Election Act. The Chief Election Commissioner said in the reply letter that conducting the election is the responsibility of the Election Commission and the Election Commission takes it seriously.
